It has become very clear to the leaders of international and non-governmental organizations that national governments no longer have the financial resources to fund ambitious programs for the realization of economic rights for all. Instead, they are seeking to hold large transnational corporations responsible for the realization of all human rights for those living in the countries in which they do business.]]></description>

<description><![CDATA[Frustrated by successful bi-lateral trade agreements entered into between the United States and developing countries that encourage the adoption of sound national intellectual property policies and the waiver of the provisions of an international agreement that offers developing countries flexibility in securing access to generic medicines, two separate groups have submitted an allegation letter and declaration with several United Nations agencies requesting that they intervene.  These two recent submissions evidence the larger role that non-governmental organizations ("NGOs") want the UN to play in globally governing national domestic policies and transnational corporations for the redistribution of wealth and property rights without respect for democratic processes and the rule of law.]]></description>

<description><![CDATA[Since 1979, the United Nations has been encouraging nations to ratify an international treaty that places the UN at the center of the governance of outer space. The so- called "Moon Agreement" requires that all activities on the moon and other celestial bodies be carried out in accordance with international law, in particular the Charter of the United Nations. The Agreement also provides that the exploration and use of outer space "shall be the province of all mankind and shall be carried out for the benefit and in the interests of all countries, irrespective of their degree of economic or scientific development." Recent actions taken by the administration of U.S. President Barack Obama indicate that it has decided to support the UN in its quest to govern outer space for the collective good of humanity. This explains the recent statement of NASA Administrator Charles Bolden that "NASA is not only a space exploration agency, but also an earth improvement agency."]]></description>

Ultimately, these variations on capitalism should be rejected in favor of a constructive capitalism that is rooted in the further democratic development of market capitalism at the national level, with a focus on the consideration and lawful adoption of appropriate human rights legislation and corresponding practices.]]></description>

In particular, the reports explain that, even as the pandemic officially continues, the WHO has failed to adequately disclose the degree to which the scientific experts upon whom the WHO relied to declare and manage the pandemic had financial ties to the pharmaceutical companies that manufactured the vaccines and anti-flu medications used to combat the outbreak and effects of the H1N1 influenza.]]></description>

Instead, America must accept a new international order where, instead of free and hard-working Americans deciding how to use their excess wealth for their benefit, the benefit of their fellow Americans, and the benefit of other nations, Americans will work hard to support failing social welfare programs domestically and abroad and to finance the "clean" growth of developing countries so that wealth imbalances among nations can be eliminated.  Under the NSS, America&#39;s guiding principles are transformed from life, liberty, and the pursuit of happiness to work, redistribution, and the pursuit of balance.]]></description>

<title><![CDATA[Global Leaders Rely on Right to Development to Balance World Economy]]></title>

<description><![CDATA[During the past decade, the so-called "right to development" has been promoted as an ideal to which developed nations should aspire for the benefit of individuals residing in developing countries.  More recently, foreign policy analysts viewed the realization of the right to development as a tool to eliminate the extreme poverty that, in their view, leads individuals to embrace violent extremist ideologies and actions.  Now, to remedy the financial impact of Europe&#39;s economic crisis, politicians and economists are viewing the international funding of the right to development as a means of growing the economies of developing countries so that they can purchase capital goods produced by developed countries.  Most likely, this third formulation of the right to development will lead to the global governance of national economies and the imposition of international taxes to fund capital projects in developing countries.]]></description>

<title><![CDATA[U.S. Supreme Court Clarifies Limits on Its Use of International Law]]></title>

<description><![CDATA[It is unfortunate that, in the recently decided case of Graham v. Florida, the Supreme Court of the United States refers to international opinion against the sentencing of juveniles to life without parole as support for the Court&#39;s decision. Nevertheless, it is important to note that, in the Court&#39;s majority opinion, Justice Anthony Kennedy clarifies and significantly restricts the Court&#39;s use of international opinion, at least in cases where the Court is involved in interpreting the Eighth Amendment&#39;s prohibition against cruel and unusual punishment. The Court explained that the judgments of other nations and the international community are not dispositive and are used only for support for the Court&#39;s own independent conclusion on the matter. No doubt, this evolution in the Court&#39;s approach disappoints those transnational progressives who had petitioned the Court to use international laws and practices to guide the Court&#39;s Eighth Amendment analysis, rather than to merely support a decision of the Court based exclusively on domestic laws and practices.]]></description>

<description><![CDATA[Facing economic collapse from crushing debt levels attributable to  stagnant economic growth, bloated government-run welfare programs, and  unfunded public sector wage, benefits, and pension obligations, European  Union ("EU") nations desperately need a new source of revenues.  For  the EU, the proceeds from the auction of carbon emission allowances to  businesses, the cost of which the businesses can pass along to their  customers, represent a form of tax revenues that EU member states can  use to support struggling European national economies and lessen or  postpone the negative impacts of the politically difficult economic  transformations.  Unfortunately, as the EU looks forward to the third  phase of its Emissions Trading System ("ETS"), during which its member  states will be able to auction off even more carbon permits, it need  only look to the states of New York and New Jersey for inspiration on  the use of auction proceeds to sustain runaway government spending.]]></description>

<title><![CDATA[Economic Global Governance Must Incorporate Authentic Moral Standards]]></title>

<description><![CDATA[In an April 30, 2010 address to social scientists meeting in Rome, Italy, Pope Benedict XVI provided his further insights regarding the moral standards that should guide the work of any international authority responsible for the global governance of economic life.  Ironically, only a few days earlier, in an April 26th keynote address to the Council on Foreign Relations in New York City, Jean-Claude Trichet, President of the European Central Bank, explained his vision for the global governance of the economic and financial sphere.  Unlike Pope Benedict&#39;s emphasis on the moral dimension of the global governance of economic life, Mr. Trichet&#39;s vision lacked any reference to moral standards, a glaring omission in light of the moral shortcomings that caused the global financial crisis and the moral underpinnings of the common good about which those globally governing economic life should be concerned.]]></description>

<description><![CDATA[The Group of Twenty ("G-20") nations, the new Financial Stability Board ("FSB"), and the International Monetary Fund ("IMF") are progressing on two fronts: the monitoring and revision of national and regional economic plans to facilitate global economic governance; and the pursuit of a financial industry regulatory reform agenda. The recent remarks of IMF Managing Director Strauss-Kahn indicate that these two areas may only be the beginning and that efforts will be made to globally govern other economic and industry-specific areas that, in the opinion of international economic and human rights experts, pose risks to global economic stability. Thus, corporate executives, employees, shareholders, and other stakeholders in the energy, pharmaceutical, food, and other industries whose products, or lack thereof, pose "risks" that conceivably contribute to global poverty should be prepared for a new global level of monitoring, intervention, and regulation by the G-20, IMF, World Bank, and other international organizations.]]></description>

<description><![CDATA[A special advisor to the United Nations Human Rights Council has recommended that two UN human rights bodies become responsible for monitoring national counter-terrorism efforts to determine whether they violate a right to privacy under international human rights law.  If this occurs, nations would have to prove to UN investigators that the surveillance, data gathering, search, and watch list monitoring activities used to prevent terrorist attacks conform with a proposed global declaration on data protection and data privacy.  If, in the opinion of the UN, one or more of a nation&#39;s counter-terrorism efforts do not satisfy the UN&#39;s permissible limitations on the right to privacy, UN Human Rights Committee staff and supportive non-governmental organizations would assist individuals in filing complaints against the nation.]]></description>

The Council of Europe&#39;s recent adoption of a plan for assessing whether European nations are governing their health care systems in a manner that is designed to realize the "right to health" is the final step in the creation of a matrix of health governance networks that will transform European national health care systems into a single federal health care system. This matrix, consisting of ten networks that work on pursuing an ambiguous and expensive human right to health (not on the effective and efficient delivery of quality health care), provides an operational model for those parties in the U.S. who support a taxpayer-funded, government-run national health system.]]></description>
